One of the most common questions homeowners ask is: “Do I need a permit for fence installation?” The short answer is: sometimes—but not always. Let’s break down what you need to know.


When a Permit Isn’t Required


For many typical residential fence projects, you won’t need a permit: Fences at or below 6 feet tall in most rear and side yards can usually be installed without submitting a building permit application to the NYC Department of Buildings (DOB).


This makes smaller privacy or decorative fences relatively simple to put up, as long as they stay within the city’s height limits and meet zoning rules.


When You Do Need a Permit


You will need a permit in the following situations:


1. Fences Over 6 Feet Tall

If your fence stands taller than 6 feet, even in a backyard, you generally must submit a Plan/Work Approval Application (DOB Form PW1) and get approval before installation.


This applies to both:

  • Higher privacy/security fences
  • Specialty or decorative fences that exceed allowed heights


2. Non-Residential or Complex Properties

Fences for commercial sites, industrial facilities, or unusual installations (such as barrier fences for construction sites) often require permits or additional filings with DOB or other city agencies.


For temporary or construction site fences—like those used around renovation projects or open excavations—the permit process is handled through DOB NOW and may include specific safety and design requirements.


3. Landmark or Historic District Properties

If your property is in an NYC historic district or landmarked, you’ll need approval from the Landmarks Preservation Commission before installing or modifying a fence, regardless of height.
